Notariety, LLC Terms and Conditions

Welcome to Notariety, LLC! By requesting a quote, scheduling an appointment, or using our services, you agree to be bound by the following Terms and Conditions. These terms form a legally binding agreement between you ("Client," "you," or "your") and Notariety, LLC, an Arizona-commissioned mobile notary public (referred to as "Notary," "we," "us," or "our").

1. Our Services and Limitations
1.1. Notary Public's Role: We are commissioned as a Notary Public in the State of Arizona. Our sole responsibility is to act as an impartial witness to the signing of documents, verify the identity of the signer(s), and administer oaths or affirmations when required. We are not attorneys and are not authorized to practice law.

1.2. No Legal Advice: We cannot provide legal advice, prepare legal documents, select documents for you, or interpret the contents of any document. If you have questions about the document you need notarized, its purpose, or its legal effect, you must consult with a qualified attorney.

1.3. Service Area: Our mobile notary services are provided within the State of Arizona, serving all of Arizona.

2. Fees and Payments
2.1. Quote and Pricing: Our service fees are outlined in the quote provided to you. All quotes are valid for a period of 10 business days from the date of issuance unless otherwise specified. Quotes are subject to change if the service details, such as the number of signers, documents, or location, change after the quote is accepted.

2.2. Fee Breakdown: Your final invoice will include the following charges:

Service Fee: The base package price for the specific service package you request (e.g., Affidavits, Wills, Loan Documents).

Notarial Acts Fee: A fee of $10 per notarial act (signature), as regulated by the State of Arizona. This fee is included in the Base Package Price for all services.

Travel Fee: A fee for our travel to your location, calculated based on the round-trip distance from a centralized location at Phoenix Sky Harbor Airport (PHX) to the signing location. Our tiered travel fee structure is as follows:

0 - 50 miles: (Included in Base Package Price)

51 - 150 miles: Additional $150 on top of Base Package Price

151+ miles: Additional $300 on top of Base Package Price

Additional Fees: Any applicable fees for printing, additional signers, after-hours service, or other services as detailed in our pricing guide on our Services Page.

2.3. Payment: Full payment is required prior to the start of the notarization process. We accept payment via credit card or other electronic methods as specified on our invoice or quoting platform (Check Cherry) or scheduling platform (NotaryAssist). We do not accept cash, personal checks, or wire transfers unless a special arrangement is made. Any transactions with insufficient funds will be subject to a $25 NSF fee in addition to the original charge.

3. Appointment Requirements and Cancellations
3.1. Required Identification: Each signer must present a valid, unexpired, government-issued photo identification at the time of the signing. Acceptable forms of ID include a U.S. driver's license, state ID card, or passport. We cannot proceed with the notarization without proper identification as defined by Arizona State law.

3.2. Signer Readiness: The client is responsible for ensuring all signers are present, have valid identification, are of sound mind, and are willing to sign the document. The document must be complete and ready for signature before the notary arrives, with all blanks filled in, unless otherwise advised by an attorney.
3.3. Cancellation and No-Shows: If a notary travels to a location and the notarization cannot be completed due to the fault of the signer (e.g., no ID, documents not ready, signer is a no-show, signer is not of sound mind), the client will be responsible for the full travel fee and a cancellation fee of $50.
3.4. Rescheduling: Appointments can be rescheduled at no charge if done with at least 24 hours' notice prior to the scheduled appointment time. Rescheduling with less than 24 hours' notice may be subject to a fee.
4. Notary's Rights and Limitations
4.1. Right to Refuse Service: We reserve the right to refuse notarization services if:

The signer lacks proper identification or appears to be signing under duress or coercion.

The document is incomplete, contains blank spaces, or appears to be fraudulent.

The notary is a party to or has a financial interest in the transaction.

The notary has reason to believe the transaction is illegal or improper.

4.2. Document Legality: We are not responsible for the legality, validity, or effectiveness of any document. Our role is limited to the notarial act itself. The client is responsible for ensuring the document is appropriate for its intended use.
4.3. Notary Journal: As required by Arizona State law, we will record information from each notarial act in our secure notary journal. This includes your name, signature, address, and information about the document and your identification.
5. Liability and Indemnification
5.1. Limitation of Liability: To the maximum extent permitted by law, our liability for any claims arising from our services is limited to the fees paid by you for the specific service in question. We are not liable for any indirect, incidental, or consequential damages.
5.2. Indemnification: You agree to indemnify and hold harmless Notariety, LLC from any claims, damages, or liabilities arising from your use of our services, including but not limited to any claims related to the content or legality of your documents.
6. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Maricopa County, Arizona.

7. Changes to the Terms
We reserve the right to update these Terms and Conditions at any time. We will notify you of any changes by posting the new terms on this page. Your continued use of our services after any changes constitutes your acceptance of the new terms.
